Rape sentencing: WD case and beyond

Abstract

This handbook conducts an analysis of the sentences imposed for rape by Irish courts. Part I examines The People (DPP) v. WD [2007] IEHC 310 by outlining the salient points of the decision, in particular the separation of rape sentences into categories of punishments. The mitigating and aggravating factors are also laid out.
Part II analyses recent sentences for rape since 2007. All reported Court of Criminal Appeal (CCA) cases post The People (DPP) v. WD are included as well as a survey of two years of Irish Times reports (covering the period November 2010 to November 2012).
