N2 - The paper discusses ways to construct a more efficient and balanced European patent system. It identifies and describes challenges relating to innovation, to non-economic issues and to governance. In order to improve the patent system, a cautious approach of “Muddling through” is recommended. More concretely, the paper puts forward some of the solutions proposed in the STOA Report to the European Parliament on “Policy options for the improvement of the European patent system” and suggest initiatives such as the insertion of a mission statement in the EPC, improvement of patent quality, increasing access to patented inventions and enhancement of governance.
