Abstract
In 2015, as the Nordic countries celebrate the 100th anniversary of the Nordic Contract Act (NCA), there is also good reason to celebrate the fact that - due to recent developments - the original field of NCA application has been narrowed in one important respect. In particular, the contract formation rules in NCA Chapter I – which for nearly 100 years applied by default to all contracts – no longer apply to contracts for the international sale of goods. As regards this latter significant
contract category, Chapter I of the NCA has (except for inter-Nordic sales)
been pre-empted, i.e. replaced, by Part II of the 1980 United Nations Convention
on Contracts for the International Sale of Goods (CISG).
