Short presentation

The research proposal highlights the hotly debated issue of excessive pricing in the field of pharmaceuticals as an anti-competitive practice within European Competition Law & TRIPS.

The thesis conducts an investigation of the triangular dilemma of Intellectual Property Rights, Competition Law as well as Law & Economics. The questions to be answered are mainly “how much is too much” and “how to define excessiveness” in order to have both a legal as well as economically sound approach to alleged excessive price cases in the pharmaceutical sector.

Further questions to be answered are what constitutes a “fair price” and if “fairness” can be translated into administrable legal standard in relation to the goals of Competition Law as well as Intellectual Property Law.

Behrang Kianzad holds a Master of Laws from Lund University, Sweden, and is since September 2017 enrolled as PhD-fellow at Copenhagen University, joining the newly set up Center of Advanced Studies in Biomedical Innovation Law.

His main research topics deal with the intersection of Intellectual Property and Competition Law, specifically in regards to patented pharmaceutical products and excessive prices. He has previously presented his research at WTO / WIPO, ATRIP, World Intellectual Property Forum as well as 7th Law & Economics Conference in Lucerne to name a few.

He has previously worked some 15 years as journalist and lecturer in journalism, where he co-authored a course book on multicultural journalism, and went on to work and lecture on digital communications. He has been employed by Swedish Radio & TV, TIME Magazine, European Commission and Swedish Aid Agency to name a few.

Behrang Kianzad is a member of the standing TRIPS Committee of International Association for the Protection of Intellectual Property (AIPPI) and he has also been advisor to Expert Advisory Group on Complex Pricing (EAGCP). He regurlarly presents his research at international conferences on the theme of pharmaceutical pricing, competition law and intellectual property.

Teaching

Behrang Kianzad teaches master-level courses in EU Intellectual Property Law, Life Science Law as well as EU Competition Law at the Faculty of Law, Copenhagen University.

Behrang Kianzad is fluent in Swedish, English, German, Danish and Persian and commands some knowlegde of Spanish as well.
