Human tissue and data derived for the samples of human tissue play a growing role in the development of biomedical research. In relation to human genetic biobanks we see new clusters of ethical and legal problems related to the protection of the rights and wishes of donors. Genetic research makes it important to take a second look at what legal tools be best suited to the area of human genetic biobanking: How to secure the dignity and autonomy of donors and protect the privacy of the personal data derived from the samples while respecting the principle of freedom of research in order to create new knowledge for the benefit of future generations?
